About “The Powers of the Convention to Form a Mixed Government Examined and Sustained”
Federalist No. 40 is an essay written by James Madison, the fortieth in the series of The Federalist Papers. It was published on January 18, 1788, in The New York Packet under the pseudonym Publius, which was used for all the essays. This paper is the last of four by Madison that discuss the authority of the constitutional convention responsible for creating the proposed United States Constitution.
